Definitions
Voucher means the gift voucher issued by Chargefox to you as a prepaid eGift card.
Chargefox Terms and Conditions means the terms and conditions published here https://www.chargefox.com/legal/terms-conditions, as amended from time to time.
Expiry Date means the date being 36 months from the date the Voucher is issued, following which any remaining funds on a Voucher will not be available for Redemption.
Redeem means to reduce the Voucher Balance on your Voucher by using the Voucher to purchase goods or services at Participating Chargefox Stations, and “Redeemable”, “Redeemed” and “Redemption” have corresponding meanings.
Participating Chargefox Stations means all Chargefox charging stations, excluding those charging stations listed on the website here:
Value Redeemed means the amounts redeemed using the Voucher
Voucher Balance means the unspent value of a Voucher
Chargefox means Chargefox Pty Ltd, ACN 621 161 215
Website means www.chargefox.com
You means the purchaser or user of the Voucher.
- Agreeing to the Terms and Conditions
- These terms and conditions apply to each Voucher.
- You agree to be bound by these terms and conditions by purchasing, activating, using or attempting to use a Voucher, or by making a transaction enquiry or exercising any right to Redeem value loaded on a Voucher.
- By purchasing, activating, using or attempting to use a Voucher, or by making a transaction enquiry or exercising any right to Redeem value loaded on a Voucher, you warrant to us that You will comply with these terms and conditions and the Chargefox Terms and Conditions (a copy of which can be found here: https://www.chargefox.com/legal/terms-conditions) and all applicable laws and that the Voucher will not be used in any manner which is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers.
- If you give the Voucher to another person, You should ensure that they are aware of the relevant terms and conditions that apply to the Voucher and the relevant Expiry Date of that Voucher.
- Redeeming your Voucher
- Your Voucher can only be Redeemed for the disbursement of charging services at Participating Chargefox Stations up to the value loaded on your Voucher. Value Redeemed is deducted from the Voucher Balance.
- Vouchers cannot be refunded or used to obtain cash. You cannot use your Voucher to make a credit card payment or other transaction payment.
- Vouchers cannot be used for the payment of any idle fees or any other infringements costs You may incur or be otherwise liable for whilst receiving charging services.
- Resale of Vouchers are strictly prohibited, except with our prior written consent. Vouchers that are sold in breach of this clause 2.4 may be considered invalid and Chargefox is not obliged to allow users of those Vouchers to use or Redeem the Voucher Balance on their Voucher.
- Your use of the Voucher at a Participating Chargefox Stations is subject at all times to the policies (and where applicable, other terms and conditions) of Chargefox and Participating Chargefox Stations regarding the goods and services made available by it.
- Where the price of a charging session being purchased by the Voucher exceeds the Voucher Balance, You must pay the amount in excess of the Voucher Balance by the payment method linked to your Chargefox account.
- Once the Voucher has reached its Expiry Date (or has a Voucher Balance of zero dollars), it cannot be used.
- The Redemption of Vouchers is restricted to the purchase of the standard disbursement of electricity.
- Any Voucher Balance unused at the Expiry Date will be forfeited and will not be refunded or attributed to any transactions after the Expiry Date.
- No Recharging of the Voucher
- After a Voucher has been activated, You are unable to subsequently add or load value to the Voucher.
- Transaction Enquiries
- You can check your Voucher transaction history and Voucher Balance by viewing your transaction history and Voucher Balance via the Chargefox App.
- Lost or Stolen Voucher
- You must treat your Voucher like cash. If your Voucher code is lost or stolen, please contact us via submitting a service request at https://support.chargefox.com/hc/en-au/requests/new.
- Chargefox reserves the right to place a stop on your Voucher if:
- You report that your Voucher has been lost, stolen or deleted;
- Chargefox reasonably believes that You have used (or will use) your Voucher contrary to these terms and conditions; or
- Chargefox reasonably believes that there is an error with your Voucher.
- Liability
- You are responsible for the security, use and safety of your Voucher and applicable Voucher Code. Please be careful or scams and Chargefox does not take any responsibility where You give access to your Voucher to a third party that is not in a manner set out in these terms.
- Without excluding, restricting or modifying the rights and remedies to which You may be entitled under the consumer guarantee provisions of the Australian Consumer Law (and any other non-excludable statutory right) our liability to you in all cases will be limited to a refund or reissue of your Voucher up to the value of the Voucher.
- We will not be liable to You for indirect and consequential loss arising from or connected to these terms and conditions in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of Chargefox’s own negligence or wilful misconduct.
- Chargefox’s liability to you for loss or damage of any kind arising out of or in connection with these terms and conditions or your Voucher is reduced to the extent (if any) that You cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.
- This clause 6 shall continue to apply even after these terms have ended and the Voucher Balance is zero or forfeited.
- Relationship with Us
- Vouchers may be used as a personal or business gift but must not be used in connection with any marketing, advertising or other promotional activities (including without limitation to websites, internet advertisements, email, telemarketing, direct mail, newspapers and magazine advertisements, and radio and television broadcasts) unless you obtain our prior written approval. Vouchers that are used in breach of this clause 7 may be considered invalid and we are not obliged to allow the users of those Vouchers to Redeem the Voucher Balance for those Vouchers.
- Use of the Chargefox name, brands or logos is strictly prohibited.
- You must not use your Voucher is any matter that states or implies that any person, website, business or product or service is endorsed or sponsored by or otherwise affiliated with Chargefox or any of its affiliates.
